It happens for both my locally compiled version and the intrepid wpasupplicant deb package produced binaries. Who knows, but seems to be working for now.

The open-source brcmfmac driver is available from the brcm module of the linux kernel package, maintained upstream by the linux kernel community. Not sure what you mean with blacklisting. Considering the previous response to this thread was two months ago, has there by any chance been any progress for individuals with this situation.
